Braintality BV provides this privacy statement in order to provide insight into the use of personal data on Braintality.nl (hereinafter "the Website"), and all domains related to the Website..

1. WHAT DATA IS PROCESSED.
When using the website or services of Braintality BV, the following personal data may be collected and processed:

2. PURPOSE OF DATA PROCESSING
In compliance with privacy laws, users' personal data are used exclusively for the following purposes:

3. RECIPIENTS OF PERSONAL DATA
Personal data may be provided by Braintality BV to third parties if this is compatible with the purpose stated in this privacy statement for which the data was collected. Data may be passed on to the following recipients on behalf of Braintality BV:

4. DATA RETENTION PERIOD.
Personal data will not be used or stored by Braintality BV longer than necessary to achieve the purposes for which the data is collected in accordance with this agreement.
5. RIGHTS OF THE USERS
The user of the website can at any time exercise his/her rights towards Braintality BV.
The user can make his request to exercise one or more of his rights known to Braintality BV through one of the contact details of Braintality BV or the Data Protection Officer mentioned in this privacy statement.
Braintality BV will respond to the user's request, unless the request is unfounded or excessive.
Braintality BV shall respond to the user's request within one month after the request, also when the request is not complied with.
The response to the request should be clear to the user, and should be provided to the user in writing or by other (electronic) means.
a. Right to information about processing operations.
The user of the website has the right to a clear and transparent explanation about the data processing.
Through this privacy statement Braintality BV provides information about the source of the data, the data recipient(s), the objectives, necessity and basis of the data processing, the data protection guarantees, the retention period, the contact details for complaints, the rights of the user.
b. Right of access.
The user of the Website has the right to inspect, at reasonable intervals, his personal data that has been collected.
Braintality BV shall, if requested, provide the user with access to an overview containing at least the following data relating to the user:

When the user requests access to their collected personal data, before access is granted, the identity of the user is established by Braintality BV.
If a copy of the data is provided to the user, no costs will be charged for providing the copy, unless the user wants to receive multiple copies and a reasonable fee can be charged based on administrative costs.
The copy shall be offered in writing, including in electronic form.
If the user submits the request for inspection electronically, the copy of the data shall also be provided by electronic form, unless the user requests otherwise.
A copy of the personal data will be provided to the user within one month of the request.
c. Right of rectification.
The user of the Website has the right to correct or complete his personal data if it is not accurate.
If the user does not have the ability to correct or supplement their personal data themselves, the user may instruct Braintality BV to correct or supplement their personal data.
Braintality BV will inform all recipients of the personal data of the changed data, unless this proves impossible or requires disproportionate effort in relation to the interests of the user. Braintality BV provides the user with information about these recipients if requested by the user.
d. Right to data erasure.
The user of the Website has the right to have their collected personal data erased by Braintality BV, if one of the situations mentioned in Article 17, paragraph 1 of the General Data Protection Regulation applies.
Also, the user has the right to 'be forgotten' if Braintality BV has made personal data of the user public and the user requests the erasure of his data. Braintality BV should in this case take the necessary measures to inform other data controllers that the user wants to erase his personal data or any copy thereof.
There is no need to comply with a request to erase personal data if the processing of the data is necessary for one of the reasons mentioned in Article 17, paragraph 3 General Data Protection Regulation.
e. Right to restrict processing.
The user of the website has the right to restrict the processing of his personal data if one of the situations mentioned in Article 18, paragraph 1 General Data Protection Regulation occurs.
In the case of exercising the restriction of personal data processing, the data may only be processed:

for the establishment, exercise or substantiation of a legal claim;

to protect the rights of third parties or for important reasons of general interest for the European Union or a Member State.
Braintality BV shall inform all recipients of the personal data of the restriction of data processing, unless this proves impossible or requires disproportionate effort in relation to the interests of the user. Braintality BV provides the user with information about these recipients if requested by the user.
f. Right to data portability.
The user of the website has the right to obtain his/her personal data from Braintality BV in a structured, common and machine-readable form and transfer it to another processing controller, without Braintality BV hindering him/her in doing so, if one of the situations mentioned in Article 20, paragraph 1 of the General Data Protection Regulation applies.
If the user exercises his right to data portability, the user also has the right that the personal data be transferred directly from one processing controller to another, unless this is technically impossible.
The exercise of the right to portability does not affect the right to data erasure. This right shall not apply to processing that is necessary for the performance of a task carried out in the public interest or in the exercise of public authority vested in Braintality BV.
The exercise of the right to portability does not affect the rights and freedoms of third parties.
g. Right of objection.
The user of the Website has at all times the right to object, due to his specific situation, to the processing of his personal data by Braintality BV.
In the above case, Braintality BV will cease processing the user's personal data, unless Braintality BV can cite compelling legitimate grounds for the processing which outweigh the interests, rights and freedoms of the user, or which are related to the establishment, exercise or substantiation of a legal claim.
When processing personal data for direct marketing purposes, the user has the right to object to the processing of his personal data at any time.
If the user objects to data processing for direct marketing purposes, the data will no longer be processed for these purposes.
h. Right to complain
The user of the website has the right to file a complaint regarding the processing of his personal data by Braintality BV with the Personal Data Authority.
Both complaints relating to the processing of the user's personal data, as well as complaints relating to improper compliance with applicable legislation may be filed.
